IMPORTANT CONDITIONS FOR APPLYING TO JOIN THE AMATEUR RIDERS CLUB OF AMERICA.

1. In conjunction with Fegentri, the International Federation of Amateur Riders, the following definition of "Amateur" shall be accepted for membership to ARCA with regard to Amateurs competing in flat races at recognized race meets in North America and Europe: "An individual 16 years or older may ride as an Amateur subject to having never received payment for riding in a horse race nor having received payment for winning or placing in a horse race during his/her riding career."

2. In conjunction with the rules applied by the National Steeplechase Association, an individual who has qualified his/herself as an Amateur Rider to compete in NSA sanctioned races on the flat or over jumps will qualify to apply for membership to ARCA. His/her race results will qualify for Amateur Championship honors. However the individual may be excluded from the opportunity to ride at recognized race meets (those where wagering is in effect) on the flat if they fail to meet the criteria described in (1).

Any applicant found to have abused or is found trying to abuse the above conditions shall be disqualified or denied membership privilege by ARCA, and all racing authorities shall be notified immediately. The Board of Directors of ARCA reserves the right to review all applications for membership and possesses the right to deny membership privilege on any grounds that may include and are not limited to the individual’s ability to uphold the standards, credibility and qualification of the sport of Amateur Racing.

3. As further consideration for the granting of membership in ARCA, the applicant expressly assumes any risk with respect to participation in any race and agrees as follows:

a) To indemnify and hold harmless the sponsoring committee, race committee or racing association, any charity or other beneficiary who may benefit from the races; the Amateur Riders Club of America; the owners, lessees, lessors or licensees of any premises where a race meet may be held; all directors, officers, trustees, agents, employees, servants and licensees of any entity included in this paragraph (3A), from any claim for injury suffered or sustained by any person, entity, or horse including without limitations not only all third parties but also all other members, riders, entrants, horses and any person performing services for any of the indemnified parties arising out of the conduct of a race meeting.

b) Member shall be responsible for any injury or damage caused by him/ herself, his/her agents and employees.

c) Applicant waives his rights against and forever discharges and releases the indemnified parties herein from liability for any claim which applicant may now or hereafter have for any injury arising out of or otherwise related to the member participating in a sanctioned race, including but not limited to any claim under law, tort, contract, statute, or custom including negligence or breach of statutory duty or both on the part of an indemnified party.

5. An applicant wishing to ride on the flat at a recognized race track must certify and provide confirmation that he/she carries and has in effect adequate and appropriate medical and injury insurance. Applicants are hereby warned that workmen’s compensation insurance carried by their employer most likely will not cover them if they are riding for a non-employer. All applicants should seek advice and counsel from their own insurance agents and advisors, and ARCA expressly declines to offerany such advise.
